MOPI Code of Ethics

The MOPI Code of Ethics for Sales and Marketing Practices of Prescription Products sets out standards to guide interactions between pharmaceutical companies and healthcare professionals, ensuring that such interactions are appropriate, ethical, transparent, and professional.

Patient and Healthcare Focus

Practices are guided by patient interests and responsible engagement with healthcare professionals.

Accountability

Members are responsible for upholding the Code and are subject to a transparent complaints and adjudication framework.

Transparency

Product information should be accurate, fair, and balanced to support informed prescribing decisions.

Independence

Healthcare professionals’ prescribing decisions must remain free from improper influence.

Legitimate Intent

Interactions should be conducted for proper reasons, in accordance with the law and the spirit of the Code.

Integrity

Members are expected to act ethically, honestly, and respectfully in their engagements.

Through the Code, MOPI reinforces responsible conduct, fair competition, and ethical engagement across the local pharmaceutical manufacturing industry.

Through the Code and its accompanying complaints and adjudication framework, MOPI reinforces a culture of responsible conduct, fair competition, and public trust in the local pharmaceutical manufacturing industry. The Code is aligned with relevant Malaysian laws and internationally recognised best practices.

MOPI Competition Policy

MOPI members participate in industry discussions in accordance with Malaysia’s Competition Act 2010 (Act 712), which prohibits anti-competitive agreements and abuse of dominant position.

Industry Advocacy

MOPI serves as the voice of the industry, engaging stakeholders on policies that support access to quality and affordable medicines.

Collective Industry Discussion

MOPI’s Executive Committee and members meet to discuss industry-wide challenges and strategies to support the development of the local pharmaceutical manufacturing industry.

Competition Law Compliance

All participants are required to comply with Malaysia’s Competition Act 2010 (Act 712), including avoiding discussions that may restrict competition or involve commercially sensitive information.

Meeting Reminders

For every MOPI meeting, the Secretariat reminds participants of the Competition Policy, including:

  • The purpose of meetings is to discuss industry issues and policy matters through proper advocacy and communication.
  • Participants should avoid discussion of individual company business practices or future plans, including prices, rebates, promotional activities, payment terms, or other commercial information.
  • Participants should raise concerns if any discussion appears inconsistent with the Competition Policy.
